From 2 October 2026, Australia changed the rules for lodging a Student visa, subclass 500, and a Student Guardian visa, subclass 590. The Department of Home Affairs factsheet is the source for the rules below. This note is NP EXPLAINS. The rules apply to all nationalities.
Most people who already hold a temporary visa in Australia can no longer apply for either visa from inside the country. If the person must apply offshore, they must be outside Australia when they lodge the application and when the visa is granted. A person who already holds a Student visa and applies for another Student visa while still in Australia is covered by that onshore bar as well, unless an exemption applies.
The factsheet says: "The changes do not affect your current Student visa." An application lodged before 2 October is assessed under the old rules. Hindustan Times reports both points. This change is not an order that a current student must leave.
The factsheet lists onshore exemptions. They include up to 12 more months to finish with the same education provider, sponsorship by DFAT or Defence, a PhD, primary or secondary school, and progression to a higher AQF level. The factsheet also lists some moves between non-AQF and AQF courses. This note does not reproduce that list. A provider that has defaulted is also an exemption. A reader who thinks one of these fits should read the factsheet, not this summary.

The factsheet keeps that option for a PhD student, a student sponsored by DFAT or Defence, a holder of a foreign government scholarship, and an eligible Pacific or ASEAN student. Family cannot be added after the visa is granted. The factsheet states no exemption to that bar.
Hindustan Times reports a further point: an onshore application lodged when the person is required to apply offshore is invalid. The Times of India quotes Home Affairs Minister Tony Burke. He said the aim is to "put an end to student visa hopping". Hindustan Times also reports that Australia says it continues to welcome international students. That welcome is Australia's line, as Hindustan Times gives it. It does not cancel the lodging rules above.
Hindustan Times wrote the change up for Indian applicants. The same lodging rules, as the factsheet states them, apply to every nationality.
