This note is NP EXPLAINS. The stamp is verified for the hearing date and for the plea as it was pleaded, and developing for an order and for any reply from the Election Commission. It was checked at 12:50 pm IST on 14 October 2026. It was rechecked at 7:48 am IST on 15 October, against LiveLaw, Bar & Bench, The Hindu and Hindustan Times, and those reports were unchanged. The post went up at 7:55 am IST.

Developing: there is no Supreme Court order yet.

After Delhi's SIR, the special intensive revision of the voter list, 47,56,722 people were left out of the draft roll. That is 32.78%. They were left out under the ASDD category. ASDD stands for Absent, Shifted, Dead or Duplicate. ASDD is a category. It is not proof of fraud. The caption's plain line calls the revision a special door-to-door check of the voter list, and rounds the count to 47.57 lakh. This note uses the figure 47,56,722.

Petitioners Anjali Bhardwaj and Amrita Johri told the Supreme Court, through advocate Prashant Bhushan, that deleted voters are being asked to re-enrol through Form 6. Form 6 is the form for a new voter. It includes a declaration that the person is enrolling for the first time. Their argument is that a person who was already enrolled, and was then left off the draft, would be signing a false declaration. They argue that a false declaration risks prosecution under Section 31 of the RPA 1950, which they put at up to one year and/or a fine. They ask the court for Form 8, or for a new form. The caption describes Form 8 as the form used to correct or restore an entry. All of that is their plea. The Section 31 risk stays inside that plea.

The Hindu, LiveLaw, Hindustan Times and Bar & Bench report the plea and the hearing. On 14 October 2026 the bench of Chief Justice Surya Kant and Justice Joymalya Bagchi advanced the hearing from 30 October to 28 October. The claims deadline is 30 October. The caption's "why now" line is that the deadline is why the hearing was brought forward.

The Chief Justice said, in The Hindu's wording: "We are thinking of passing an order which will take care of this issue." LiveLaw and Hindustan Times carry minor variants of that sentence. This note quotes The Hindu. A sentence about thinking of an order is not itself an order.

There is no Supreme Court order yet. Form 6 has not been struck down. The Election Commission's response to the petition is not in The Hindu, LiveLaw, Hindustan Times or Bar & Bench, as of 12:50 pm IST on 14 October. The 7:48 am recheck on 15 October left that gap as it was: no order, the hearing still on 28 October, and no reply to the petition reported.

Hindustan Times cites the Delhi CEO bulletin for a separate set of figures: 2,20,645 Form 6 applications and 83,004 Form 8 applications, from 31 August to 12 October. Those are application counts in the bulletin. They are not a count of who was left off the draft roll, and they are not a court finding.

If you live in Delhi, check whether your name is on the voter list. That is the practical line of this note.

What is verified is the exclusion figure, the ASDD label, the petitioners' argument as an argument, the move of the hearing to 28 October, the 30 October claims deadline, and the Chief Justice's sentence as The Hindu prints it. What is developing is any order, and any reply from the Election Commission. Developing: there is no order yet.

What each side says

What is verified

The exclusion count and the ASDD label, the advanced hearing on 28 October, the 30 October claims deadline, and the Chief Justice's sentence as The Hindu records it.

The petitioners' plea

They argue Form 6's first-time declaration would be false for a deleted voter and would risk Section 31 prosecution. They ask for Form 8 or a new form. That is their argument.

Not confirmed

  • A Supreme Court order. None has been passed. Form 6 has not been struck down.
  • A reply from the Election Commission. The Hindu, LiveLaw, Hindustan Times and Bar & Bench do not report one, as of the 7:48 am recheck on 15 October.
  • Any prosecution. The Section 31 risk is the petitioners' argument about a false declaration on Form 6.
